Decision by the Board of Commissioners

The ECBE Members or individuals have the right to complain and appeal.

ECBE may consider complaints about the relevance and probity of the process leading tо а judgment (namely, about the work of the review team, individual members of the review team, or а member of ECBE staff).

Whenever possible, ECBE encourages institutions to make initial attempts to address and resolve complaints as close as possible to the point of origin, (for example with the Chairperson of the Review Team) and with the minimum of formality.

If a complaint cannot be resolved at the point of origin, a formal appeal should be made in writing.

Appeals made by ECBE Members or individuals against decisions or conduct of the BoD, the members of the BoD, the BoC, the Commissioners, the Reviewer(s), or any other committee, body or person, should follow the 3 levels procedures:

  • Level 1 - appeals are addressed to the Chairman of the BoC and to the Director of accreditation (in cc).
  • Level 2 - appeals are addressed to the President of ECBE.
  • Level 3 - appeals are addressed to the Chairman of the Committee of Appeal; this decision is final. The Committee of Appeal (CoA) decides on appeals made by ECBE Members or individuals against decisions or conduct of the BoD, the members of the BoD, the BoC, the Commissioners, the Reviewer(s), or any other committee, body or person.

Any conflict between a Member and the Agency, whether it is the BoD, the members of the BoD, the BoC, the Commissioners, the Reviewer(s), or any other committee, body or person should first be subjugated to the CoA. According to the ECBE Statutes, Members are not allowed to take further legal steps unless the conflict has been brought for appeal to the CoA, and its decision is available.

A Member or individual wishing to bring a conflict for arbitration to the CoA should write a registered letter to the President of ECBE, explaining in detail the claim. The President of ECBE must convocate the CoA within 30 days after receiving such registered letter.

The cost of the Appeal procedure will be carried by ECBE if the decision of the CoA is in favor of the one asking for the appeal. However, if the decision of the CoA is not in favor of the one asking for the appeal, the cost will be carried by the one who started the appeal procedure. The one who starts the procedure must pay the expected cost beforehand, as calculated by the CoA, as a guarantee.
